Introduction

Welcome to use the macOS file search tool provided by Liuer (hereinafter referred to as "we" or "Liuer"). These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for your use of our application, website and related services (collectively referred to as "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not use our Services.

1. License Grant

Liuer grants you a personal, worldwide, royalty-free, non-transferable, non-exclusive license to access and use our Services. The sole purpose of this license is to enable you to use the Services we provide in accordance with these Terms.

1.1 License Restrictions

You may not:

  • Copy, modify, distribute, sell, lease, mortgage, transfer or disclose any Service
  • Reverse engineer, decompile or attempt to extract the source code of the Service
  • Interfere with or disrupt the normal operation of the Service, or attempt to access the Service through unauthorized means
  • Use the Service for any illegal activity or violate any applicable law
  • Remove, obscure or alter any copyright, trademark or other proprietary rights notices displayed in the Service

2. Intellectual Property

The Service and all its content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations and software, are the property of Liuer or its licensors and are protected by copyright, trademark and other intellectual property laws.

Without our explicit written permission, you may not use our trademarks, logos or other proprietary information. You may not remove, obscure or alter any copyright, trademark or other proprietary rights notices displayed on the Service.

3. User Conduct

You agree to comply with the following provisions when using the Service:

  • Comply with all applicable laws, regulations and rules
  • Respect the intellectual property and other rights of others
  • Do not interfere with or disrupt the Service or its related servers and networks
  • Do not use the Service for any illegal, fraudulent or malicious activities
  • Do not attempt to access any part or feature of the Service without authorization

3.5 Data Processing

Liuer is designed with privacy in mind. We collect minimal data necessary for the operation and improvement of our services. For complete details on data collection and processing practices, please refer to our Privacy Policy.

  • Error logs: We may collect technical error information to improve application stability. This data does not contain personal identification information.
  • Anonymous usage data (opt-in): With your explicit consent, we collect anonymous usage statistics via PostHog to improve our services. This never includes your search queries, file names, file paths, or file content.
  • We never collect your personal files, search content, or any personally identifiable information.

3.6 Third-Party Services

We use third-party services to operate and improve Liuer:

  • PostHog — Anonymous analytics service provider, data stored on EU-based servers. Used only for opt-in usage data collection.

You can opt out of usage data collection at any time in Liuer Settings → General → Send Anonymous Usage Data. When disabled, no data is sent from your device.

4. Disclaimer

The Service is provided on an "as is" and "as available" basis without any form of warranty, either express or implied. To the maximum extent permitted by law, Liuer makes no warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Service will meet your requirements, or that the use of the Service will be uninterrupted, timely, secure or error-free. Any opinions, advice or information obtained through the Service, whether oral or written, does not constitute a warranty by Liuer.

5. Limitation of Liability

To the maximum extent permitted by law, Liuer and its officers, directors, employees, partners and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from the use or inability to use the Service or these Terms, including but not limited to loss of profits, loss of data, loss of goodwill, cost of purchasing substitute products or services, or any other intangible losses.

The above limitation of liability applies regardless of whether the damages are based on warranty, contract, tort (including negligence), product liability or any other legal theory, even if Liuer has been advised of the possibility of such damages.

5.5 User Data Rights

Under applicable data protection laws, you may have the following rights regarding your personal data:

  • Right of access: You have the right to access personal information we collect about you.
  • Right of correction: If you believe the information we hold about you is inaccurate, you have the right to request us to correct it.
  • Right of deletion: You have the right to request us to delete your personal information.

  • Right to data portability: In certain circumstances, you have the right to receive personal information you have provided to us in a structured, commonly used and machine-readable format.

6. Indemnification

You agree to indemnify, defend and hold harmless Liuer and its officers, directors, employees, partners and agents from any claims, damages, losses, liabilities, expenses and expenditures (including reasonable attorney fees and costs) arising from:

  • Your access to or use of the Service
  • Your violation of any provision of these Terms
  • Your infringement of any rights of any third party, including but not limited to any copyright, property or privacy rights

This indemnification obligation shall survive the termination of these Terms and your use of the Service.

7. Termination

Liuer may terminate or suspend your access to the Service at any time for any reason, including but not limited to your violation of these Terms. After termination, you will lose access to the Service, and Liuer shall not be liable for any losses resulting from termination or suspension.

Certain provisions of these Terms, including but not limited to intellectual property terms, disclaimers, limitation of liability, indemnification and dispute resolution, shall remain in effect after the termination of the Service.

Data handling upon termination: Upon termination, any anonymous usage data collected with your consent will be retained in aggregated, non-identifiable form. You may request deletion of any personal data by contacting us through the information provided in Section 10.

8. Changes to Terms

Liuer reserves the right to modify these Terms at any time. When we make significant changes, we will notify you through in-app notifications or other appropriate means, and publish the updated Terms in the application. Your continued use of the Service constitutes acceptance of the revised Terms.

We encourage you to regularly review these Terms to understand any changes. If you do not agree to the revised Terms, please stop using the Service immediately.

9. Governing Law

These Terms are governed by the laws of the People's Republic of China, without regard to conflict of law provisions. You agree that any legal action related to the Service or these Terms can only be brought in the courts of the People's Republic of China, and you agree to accept the exclusive jurisdiction of these courts.
